Terms of Service

Last updated DATE

These terms govern your use of hosting services provided at hostpota.to. By paying for a plan you agree to them. If you don't agree, don't use the service — and if something here is unclear, email us and ask before signing up rather than after.

1. Who we are

hostpota.to is a trading name of Done Consulting LLC, registered in STATE, at BUSINESS ADDRESS. In these terms, "we", "us", and "our" mean Done Consulting LLC. "You" means the person or organisation paying for the service.

Contact: hello@hostpota.to

2. What we provide

We provide web hosting for your website. Depending on your plan and what you ask for, this includes placing your site on a server, configuring DNS, issuing and renewing SSL certificates, taking backups, and creating mailboxes.

We set services up on your behalf. You are not given direct server or control panel access by default. If you want it, ask and we'll arrange what's appropriate.

We may host your site on infrastructure operated by third parties. We choose and manage that infrastructure, and we remain your point of contact.

3. Payment and renewal

  • Plans are billed in advance, monthly or annually, through Stripe. We do not see or store your card details.
  • Subscriptions renew automatically until cancelled.
  • Prices may change. We'll give you at least 30 days' notice by email before a change affects you, and you can cancel instead.
  • If a payment fails, Stripe retries it. If it keeps failing we'll email you before suspending anything.

4. Cancellation and refunds

  • You can cancel at any time from your billing portal or by emailing us. There is no cancellation fee and no minimum term.
  • Monthly plans: cancelling stops the next payment. The current month is not refunded, and your service runs to the end of the paid period.
  • Annual plans: if you cancel part-way through, we refund the unused whole months.
  • If we suspend or terminate your service for breaching these terms, no refund is due.
  • Before your service ends, we'll give you a copy of your site files and database on request, and help your next provider take it on.

5. Acceptable use

Don't use our hosting for any of the following. This list isn't exhaustive, but it covers the things that get servers blacklisted and customers hurt.

  • Anything illegal under US federal law or the law of STATE
  • Sending unsolicited bulk email, or hosting content advertised by such email
  • Phishing, malware distribution, or impersonating another person or business
  • Child sexual abuse material — this results in immediate termination and a report to the authorities, with no notice and no refund
  • Attacking, scanning, or attempting to gain unauthorised access to any system
  • Cryptocurrency mining, or using your hosting primarily as file storage or a download mirror
  • Content that infringes someone else's copyright or trademark
  • Consuming server resources in a way that materially degrades service for others

You are responsible for content on your site, including content added by anyone you give access to.

6. Suspension and termination

We may suspend your service if you breach these terms, if your account is significantly overdue, or if your site is actively causing harm — for example if it has been compromised and is distributing malware.

Except where the law or an immediate risk of harm requires otherwise, we'll email you first and give you a reasonable chance to fix the problem. For compromised sites we may suspend immediately and tell you straight away, because leaving it up makes things worse.

Either of us may end the arrangement with 30 days' notice for any reason. If we end it without cause, we refund the unused portion of what you've paid.

7. Your content and your data

Your website, your content, and your data remain yours. We claim no ownership of them.

We access your site only as needed to provide and support the service, to investigate a problem, or where the law requires it.

Your domain name stays registered in your name. We don't take ownership of it, and we won't hold it as leverage in a dispute.

8. Backups

We take regular backups and we'll restore from them if something goes wrong. Backups are a safety net, not a guarantee — restores can fail, and backups have a limited retention window.

If your site is critical to your business, keep your own copy as well. We'll help you set that up if you ask.

9. Availability

We aim to keep your site online continuously, and we act promptly when it isn't. We do not offer a contractual uptime guarantee or service credits at these prices.

We may take services down briefly for maintenance. Where it's planned, we'll give you notice.

10. Limitation of liability

To the fullest extent the law allows, we are not liable for lost profits, lost business, lost data, or any indirect or consequential loss arising from your use of the service.

Where we are liable, our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

Nothing in these terms excludes liability that cannot be excluded by law.

11. Changes to these terms

We may update these terms. If a change materially affects you, we'll email you at least 30 days beforehand. Continuing to use the service after a change takes effect means you accept it.

12. Governing law

These terms are governed by the laws of STATE, and any dispute will be handled in the courts of STATE.

13. Getting in touch

Questions, complaints, or anything that doesn't look right: hello@hostpota.to. We'd much rather sort something out by email than have it become a formal dispute.
